At Hotel ICON ("Hotel"), the privacy and confidentiality of user information is important. We are committed to maintaining the privacy and security of your user information and comply with applicable privacy and data protection laws. The Hotel will not disclose identifiable user information to any third party without consent. This privacy policy applies to all customers of the Hotel.

When you make a reservation or stay at Hotel ICON

Information we collect:
Directly From You: We collect information from you when you make a booking through our reservation system, stay at Hotel ICON, or respond to a survey. Information collected during the reservation and your stay may include:
  • Your name, email address, home and business address, phone number, nationality and payment card information; for some reservations we may also collect national ID/passport information on behalf of Hotel ICON where this is required by the hotel to comply with applicable local laws or by the hotel’s local policies.
  • Information relating to your membership in one of our services or programmes or those of our programme partners such as your Hotel ICON – ICON Engage membership number and
  • Information such as stay and room preferences made during your reservation such as your preferred room type and specific requests to the hotel.
If you provide personal information to us about other persons when making a booking or during your stay, for example, family members or colleagues, we ask you to make sure they are happy for their personal information to be shared with us and to direct them to read this Privacy Statement if they want to find out more about how we use their information.
From Other Sources: We also collect reservation information about you from other persons/entities, including, travel agents, websites not owned and operated by Hotel ICON, persons booking on your behalf (e.g., a family member, company representative), your employer, or other entity. We may obtain information about you from social media pages; for example, if you make a comment on Hotel ICON’s social media page or if you comment about Hotel ICON on a public social media feed. We use this information to improve our services to you and to other customers.
Automatically: We collect information about you automatically as you use our website, mobile app, our social media sites, interact with our other digital channels, and, in some instances, when we correspond with you through email. In these instances, information such as your country information, internet protocol (“IP”) address, device ID, medial access control address, your interactions with these channels, and other characteristics about your system or device may be automatically collected. This information is collected for functional purposes and to improve your experience when using these services. This information may also be used for fraud prevention, aggregated trend and statistical analysis, and for showing you more relevant advertisements and messages. More information on these practices can be found in the Hotel Website section below. We do not typically associate an IP address with your Hotel ICON – ICON Engage profile.
Special Hotel Programmes/Biometrics: At Hotel ICON, we are always seeking more ways to enhance your experience with us. A limited number of properties now offer a biometrics check-in process to eliminate your need to stand in line. Some properties also may allow room access through the collection of biometric information. These programmes are opt-in only, and any information that we collect through your participation will be used solely for the programme as described in the notice provided to you at the time of the opt-in.
 
How we use this information:
We use your information primarily to fulfil your hotel reservations and to provide and manage our Hotel ICON – ICON Engage membership programme. This may include communicating with you (e.g., sending a confirmation email) in advance of your stay. Following your stay, we may also send you post-stay communications and satisfaction surveys to get feedback on your experience.
Where we have your consent or as permitted under applicable law, we may send you marketing communications (which may include text messages or calls placed using autodialer technology) for products and services that we believe would be relevant for you. We also may use information related to you and your stays to display targeted advertisements on our websites, mobile apps, our other digital channels or on non-affiliated websites or mobile apps, or to send you more relevant messaging. Additionally, we aggregate your information with other guest information to complete trend and statistical analysis, which we use to evaluate and improve our products and services, plan new hotel locations and services, and for other market research.
We will indicate whether the requested information is mandatory; the failure to provide such information may impact our ability to and/or prevent us from providing certain services to you.
 
Who we disclose your information with:
We disclose your reservation information as follows:
  • Service Providers: We will disclose your information with service providers to provide services related to our business and to help us improve our products and services. For example, we might use a service provider or a service provider’s product for the purposes of market research and data analytics, to communicate with you and serve advertisements through their platforms or on other websites or platforms. In certain instances, subject to local consent requirements, our service providers may also assist us with various marketing campaigns. These companies are authorised to use your personal information only as necessary to provide these services to us.

We also share your stay information with other entities, which may include law enforcement, professional advisors, and other persons, in circumstances such as:

  • when we believe in good faith that the disclosure is required by law or to protect the safety of hotel guests, employees, the public or Hotel ICON;
  • when disclosure is required to comply with a judicial proceeding, court order, subpoena, warrant or legal process; or
  • in the event of a merger, asset sale, or other related transaction.

Information we collect:
We collect information from you during your membership in any of our loyalty programs and services, including our core loyalty programme, Hotel ICON – ICON Engage. Information collected during your enrolment and participation in these programs may include:
  • Your name, email address, home and business address, phone number, nationality, birthday and payment card information;
  • Your membership number and password as well as details of your memberships with any of our programme partners such as our airline or car rental partners;
  • Information that you choose to provide in your loyalty profile, such as your personal stay and destination preferences; and
  • Marketing and communications preferences, including how you prefer to be contacted by Hotel ICON as well as what types of information you are interested in hearing about.
  • Your stays at Hotel ICON, including the dates of stay, and, in some circumstances, the total HK$ amount of your stay, food/beverage and other purchases (and, in some circumstances, an itemised breakdown of your spend at the property).
We may collect this information from you, other sources, and automatically.
From You/Other Person acting on Your Behalf: We collect your information through our reservation systems and Customer Service, through our websites, through our mobile applications or through our other digital channels.
Service Providers: We may also collect information about you from other sources, including entities that assist us in confirming the accuracy of your mailing address; in some circumstances, we do not receive the updated address verification from the vendor; rather, the vendor may simply update our mailing with the address that it believes is aligned with the postal service requirements. We may also obtain Personal Information from data enrichment providers where permitted under applicable law.
Other Sources: We may obtain information about you from social media pages; for example, if you make a comment on Hotel ICON’s social media page or if you comment about Hotel ICON on a public social media feed. We use this information to improve our services to you and to other customers. We do not typically append this information to your rewards profile. We also obtain demographic information from entities, which typically is in aggregated form. We may use this information in combination with information in your profile to identify relevant opportunities about which to notify you.
Your Friends:  We may obtain information about you from friends if they refer you to us, where necessary with consent or another appropriate legal basis.
Automatically: We collect information about you automatically through our website, mobile app, our emails, and social media sites. In these instances, information such as your country information, internet protocol (“IP”) address, device ID, medial access control address, and other characteristics about your system or device may be automatically collected in accordance with an appropriate legal basis. This information is collected for functional purposes and to improve your experience using these services. This information may also be used for fraud prevention, aggregated trend and statistical analysis, and for showing you more relevant advertisements and messages. How we use this information:
We use your information to operate and provide services in connection with our loyalty programmes. We also use your information to improve our products and services. Where permitted by applicable law or where we have your consent, we also may share your information with other parties, including our loyalty partners and others, to share special offers about their own products and services with you.
 
This may include:
  • Enrolment in the loyalty programme;
  • The order and delivery of merchandise that you have redeemed online, including merchandise and services offered by our ICON Engage partners;
  • Sending you updates, account statements and other information relating to your participation in one of our programmes or services;
  • Sending you marketing communications (which may include text messages or calls placed using autodialer technology), with your consent where required by applicable law, in relation to the products and services offered by Hotel ICON or our ICON Engage membership partners or other partners or affiliates;
  • Providing you with personalized advertisements or communications for Hotel ICON and/or other products or services that we believe may be relevant for you; and
  • Analytics, statistical analysis and other research.
Although provision of much of the information requested is voluntary, the failure to provide certain information may impact and/or prevent our ability to offer you certain services.
We occasionally run promotions where we ask Hotel ICON – ICON Engage members to refer a friend to ICON Engage with consent or other appropriate legal basis. In these cases, we always ask members to make sure anyone they refer has consented to sharing their personal information with us, and to direct friends to read this Privacy Statement if they want to find out more about how we use their information.
 
How you can manage your marketing preferences:
You can manage your preferences and decide what marketing communications you would like to receive from us in our online preference centre. You can login to ICON Engage and find out more information in the communication preferences section.

Who we disclose your information with:
As part of our loyalty programs, we disclose your information as follows:
  • Loyalty partners: to provide you with the products and services that you have requested and, where permitted by law, for the partner to offer its own products and services to you. We also may choose to partner with another company to offer a product, such as a co-branded credit card. You have options about how we disclose your information; please log into the preference centre at any time to view and exercise your choices. 
  • Service providers: for the purposes of operating the programme and to provide you with the products and services that you have requested. We also use service providers to assist us with managing, carrying out and improving our advertising. These companies are authorised to use your personal information only as necessary to provide these services to us.
We also will share your information in the following circumstances:
  • When we believe in good faith that the disclosure is required by law or to protect the safety of hotel guests, employees, the public, or Hotel ICON;
  • When disclosure is required to comply with a judicial proceeding, court order, subpoena, warrant, or legal process in any jurisdiction; or
  • In the event of a merger, asset sale, or other corporate transaction.

 

When you visit the Hotel Website

The Hotel is committed to safeguarding your privacy while visiting the Hotel websites, including, www.hotel-icon.com, (hereinafter all identified URLs are collectively referred to as the "Site"). Our goal is to provide you with an Internet experience that delivers the information, resources and Hotel ICON’s product feature, marketing, promotional, advertising and other consumer-related activities (the “Services”) that are most relevant to you. To achieve this goal, part of the operation of the Site includes the gathering of certain types of information about Site users. Because we understand that your privacy is important, we wish to explain the types of information we gather and the way in which we use it.

Hotel ICON will collect the personal data from various sources of data subject (person). We respect personal data and are committed to implementing and complying with the Personal Data (Privacy) Ordinance of the Hong Kong Special Administrative Region as well as applicable local laws.

 

How we use your personal Data

Plan and purchase hotel accommodations, F&B services, events and catering services, spa services or any kind of services provided by Hotel or on our behalf

  • For payment purposes for any services, products and/or facilities, including verification of credit card details with third parties.
  • Marketing and communications with you in relation to the products and services offered by Hotel, our strategic marketing partners, and other trusted third parties (direct marketing)
  • Enter visitor’s email in our promotions or sweepstakes (direct marketing)
  • Send marketing communications or surveys to visitors (direct marketing)
  • Respond to visitor’s questions or suggestions
  • Improve service quality and hotel experience
  • Improve the effectiveness of our websites
  • For internal research purpose within Hong Kong Polytechnic University
  • Fulfill legal and regulatory requirements and administer general record keeping
  • Use special categories of data (e.g. age, health data) given that Hotel will only do so upon receiving your consent; and
  • Other purposes for which Hotel have your consent

 

Transfer of personal data

The personal data collected may be disclosed to our agents, contractors, or third-party service providers who provide services to us in connection with the processing of the personal data on our behalf for the purposes (or any directly related purpose) outlined above on a need to know basis.

 

Your personal data will only be transferred to locations outside of Hong Kong where we are satisfied that adequate or comparable levels of protection are in place to protect personal data held in that jurisdiction, and (where we are required to do so) with your consent.

 

How Long We Keep Your Personal Data

The personal data collected may be disclosed to our agents, contractors, or third-party service providers who provide services to us in connection with the processing of the personal data on our behalf for the purposes (or any directly related purpose) outlined above on a need to know basis.

 

We will retain your Personal Data for as long as is necessary to fulfil the purpose for which we collected your Personal Data and any other permitted linked purpose and in compliance with our data retention policies. For example, we will retain and use your Personal Data to the extent necessary to provide you Services, comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
 
Generally, we retain usage data for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.
If your Personal Data is used for more than one purpose, we will retain it until the purpose with the longest retention period expires; but we will stop using it for the purpose with a shorter retention period once that period expires. Our retention periods are also based on our business needs and good practice.
 

 

Your rights to the personal data

You are entitled to the following rights: right to notice on data processing, right of rectification, right to erasure, right to restriction of processing and data portability, right to object to processing (including profiling). If you wish to do these, please e-mail media@hotel-icon.com.

 

Direct marketing

Hotel would use your name, e-mail address, phone number, and other relevant contact information to send you information that we think may be of interest to you, including about news updates for Hotel products and services, special events, offers and promotions. But we will not use your personal data for direct marketing without your consent. In deciding whether or not to join such mailing lists, electronic direct mails will provide an opt-out link as “Unsubscribe instantly” allowing you to choose not to participate in Hotel lists and future online marketing. Please note that they are only used for internal research, Hotel purposes or in joint promotions with a Hotel partner. Hotel will not sell or rent any of guests’ personal information with any other party, nor use it for unapproved commercial purposes. You may request to be removed from our lists at any time. All emails distributed to our lists will contain easy, online access to unsubscribe.

 

Permission for Use

The Hotel may collect and use personal information that you submit in any manner that is consistent with uses stated in this Privacy Policy or disclosed elsewhere at the point you submit such personal information. At the time you submit personal information or make a request, the intended use of the information you submit will be apparent in the context in which you submit it. Except for direct marketing, submitting personal information, you are giving your consent and permission for any use that is consistent with uses stated in this Privacy Policy or disclosed elsewhere at the point you submit such personal information, and such consent will be presumed by the Hotel, unless you state otherwise at the time you submit the personal information. Please do not request any such communications on behalf of an individual or company if you are not authorized to make the request.

 

Secure Reservations

If you decide to make an online reservation at the Site, you will be linked to a reservation interface and an online booking engine ("Booking Engine") provided by third party online reservation service provider. While it appears to be part of our site, the booking engine is in fact provided by a third party and is governed by its privacy practices. We understand that security remains the primary concern of online consumers and have chosen the Booking Engine Vendor carefully. The Booking Engine Vendor participates in the VeriSign Secure Site Program, a top security certification program, and has a VeriSign Secure Server ID. All information sent to this site, if in an SSL session, is encrypted, protecting against disclosure to third parties.

 

Protecting your Information

We would like our Site visitors to feel confident about using the Site to plan and purchase their accommodations, so Hotel is committed to protecting the information we collect. Hotel has implemented a security program to keep information that is stored in our systems protected from unauthorized access. Our Site is hosted in a secure environment. The Site servers/systems are configured with data encryption, or scrambling, technologies, and industry-standard firewalls. When you enter personal information during the reservation process, or during a customer email sign-up, your data is protected by Secure Socket Layer (SSL) technology to ensure safe transmission.

 

Withdrawing Consent to Use

If, after permitting use of your personal information, you later decide that you no longer want the Hotel to include you on its mailing list or otherwise contact you or use your personal information in the manner disclosed in this Privacy Policy or at the Site, simply tell us by sending an e-mail, or by clicking on the "Unsubscribe" link at the bottom of our email communication to you. However, we may not be able to continue providing services to you if you entirely withdraw your consent or ask us to delete your personal data entirely.

 

Use of Aggregated Data

The Hotel is interested in improving the Site and may develop and offer new features and services. We monitor aggregated data regarding use of the Site for marketing purposes and to study, improve and promote use of the Site. In connection with such purposes, the Hotel may share aggregated data with third parties collectively and in an anonymous way. Exceptions to the Privacy Policy

The Hotel has two exceptions to these limits on use of personal information:

The Hotel may monitor and, when we believe in good faith that disclosure is required, disclose information to protect the security, property, assets and/or rights of Hotel from unauthorized use, or misuse, of the Site or anything found at the Site.

 

The Hotel may disclose information when required by law; however, only to the extent necessary and in a manner that seeks to maintain the privacy of the individual. 

 

Children's Privacy & Parental Consent

Please be aware that Hotel has not designed this Site for, and does not intend for it to be used by, anyone under the age of 16. Accordingly, this Site should not be used by anyone under age 16 without the permission of parent or legal guardian. If you are under 16, please do not provide personal data of any kind whatsoever.. Should the Hotel inadvertently acquire personal data or other information from users under the age of 16, the Hotel will not knowingly provide this data to any third party for any purpose whatsoever, and any subsequent disclosure would be due to the fact the user under the age of16 used the Site and submitted personal information without solicitation by or permission from the Hotel. If you are in the EU member states, our online services are not directed at children under the age of 13. If you are at least 13 but under the age of 16, please get the consent of your parent or legal guardian before giving us any personal data about yourself.

Retention of Personal Data

Hotel ICON User Generated Content Terms of Use

 

The Hotel reaches out to social media users to seek their permission to feature our favorite content on our various sites, social channels, and various promotional materials. You are reading this because Hotel ICON has requested your permission to use your social media content for this purpose.

 
If you choose to allow us to use your social media content (“User Content”) by replying with the hashtag #HoteliconPhoto, you agree to these Terms of Use.

 

Hotel ICON engages a number of service providers to facilitate the collection and transmission to the “Site”, social media channels, promotional materials and other properties (“Hotel ICON Properties”) of User Content, including photos, text, graphics, audio, video, location information, comments and other materials from social media sites, for use by the Hotel in connection with its business, including Hotel ICON’s Services.

 

Hotel ICON reserves the right to alter these Terms of Use without advance notice by posting a revised Terms of Use. Accordingly, you should review the Terms of Use each time you grant permission or authorization to feature your User Content.

 

User Content License

You hereby grant to Hotel ICON and its related companies, agents, licensees, sublicensees, contractors, successors, legal representatives, assigns, and third-party service providers, and their respective retail partners, marketing or public relations agencies, and other affiliates (the “Licensed Parties”) a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable, sublicensable right to use your User Content in any manner to be determined in the Licensed Parties’ sole discretion, including but not limited to on webpages and social media pages operated by the Licensed Parties, in promotional e-mails and advertisements, and in any and all other marketing, promotional and advertising initiatives, and in any media now or hereafter known. The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Content in any manner in their sole discretion, with no obligation to you whatsoever.

 

You grant the Licensed Parties the right to use your username, real name, image, likeness, descriptions of you, location or other identifying information, including but not limited to your voice, in connection with any use of your User Content.

 

You hereby agree and represent and warrant that (i) you are solely responsible for your User Content, (ii) you own all rights in and to your User Content and/or have obtained appropriate rights and permissions from any and all other persons and/or entities who own, manage or otherwise claim any rights with respect to such User Content, (iii) you are not a minor, (iv) the Licensed Parties’ use of your User Content as described herein will not violate the rights, including but not limited to copyright, trademark, patent, trade secret, privacy, publicity, moral, proprietary or other rights, of any third party, or any law, rule or regulation, and (v) the User Content is not libelous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive or otherwise unlawful.

 

You hereby release, discharge and agree to hold the Licensed Parties, and any person acting on their behalf, harmless from any liability related in any way to the Licensed Parties’ use of your User Content.

 

The User Content that you submit is deemed non-confidential and the Licensed Parties have no obligation to maintain the confidentiality of any information, in whatever form, contained in any submission, except pursuant to the Licensed Parties’ respective privacy policies. By using this Site or the Services, you are consenting to the Licensed Parties’ collection of any personal information you provide for the Licensed Parties’ use and disclosure in connection with the use of your User Content as described herein. If you do not agree to the collection, use and disclosure of your personal information in this way, please do not use this Site or the Services or otherwise provide the Licensed Parties with personal information. Your personal information may be transferred to servers located outside the country in which you live or to third parties in other countries so that they may process personal information on the Licensed Parties behalf. By using the Site or the Services or otherwise providing the Licensed Parties with personal information, you agree to the foregoing collection, use, disclosure, transfer and processing of your information in accordance with the terms of these Terms, the Privacy Policy and applicable data protection laws and regulations.

 

The Licensed Parties reserve the right to remove any User Content from the Site and the Hotel ICON Properties. If you believe any content, including User Content, residing on the Site or on the Hotel ICON Properties or displayed or used in connection with the Services infringes any person’s or entity’s copyright rights, please refer to the Copyright Policy.

 

Additional Terms

 

These Terms of Use apply to the entire Site, the Hotel ICON Properties and Services and to your User Content unless otherwise provided. In addition, to the extent your User Content is displayed on the Site or on any of the Hotel ICON Properties or in connection with the Services, you also will be subject to additional terms of use, agreements, guidelines or rules provided by Hotel ICON applicable to such Services and User Content, including but not limited to those set forth on the Hotel ICON website at https://www.hotel-icon.com/privacy, and you hereby agree to be bound by such additional terms of use or service, agreements, guidelines, instructions or rules provided or posted by Hotel ICON.

 

You certify that you are at least 18 years of age.

 

Intellectual Property Rights

The Site, Hotel ICON Services or Hotel ICON Properties may be protected by copyright, trademark and other intellectual property laws. You acknowledge and agree that you do not acquire any ownership or other rights in proprietary information and materials of Hotel ICON by authorizing use of your User Content or otherwise using or accessing the Site, the Services or the Hotel ICON Properties.

 

Miscellaneous

These Terms of Use are personal to you and may not be assigned or transferred by you for any reason whatsoever without Hotel ICON’s prior written consent; and any action or conduct in violation of the foregoing shall be void and without effect.

 

You agree that if Hotel ICON does not exercise or enforce any legal right or remedy which is contained in these Terms of Use (or which Hotel ICON has the benefit of under any applicable law), this will not be taken to be a formal waiver of Hotel ICON’s rights and that those rights or remedies will still be available to Hotel ICON.

 

If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Use are invalid, then that provision will be removed without affecting the rest of the Terms of Use. The remaining provisions of these Terms of Use will continue to be valid and enforceable.

 

Copyright Policy

Notification of Copyright Infringement

 

The Hotel respects the intellectual property rights of others and expects its users to do the same.

 

It is Hotel ICON’s policy, in appropriate circumstances and at its discretion, to disable and/or terminate the account or access of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

 

In accordance with the Copyright Ordinance (Cap. 528 of the Laws of Hong Kong), the text of which may be found on the Hong Kong S.A.R. e-Legislation website at https://www.elegislation.gov.hk/hk/cap528, Hotel ICON will respond expeditiously to claims of copyright infringement committed using the Hotel ICON website that are reported to Hotel ICON’s Copyright and Data Protection Officer, identified in the sample notice below.

 

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing all items complying the Copyright Ordinance (Cap. 528 of the Laws of Hong Kong) and delivering to Hotel ICON’s Copyright and Data Protection Officer. Upon receipt, Hotel ICON will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site and Application.
